The Participant/Learner/Website User will also assent to taking mandatory steps, which will ensure that there is no unauthorized use of any part of the certnomics.om and will help in the investigation to find out unscrupulous elements and sources that have led to unauthorized access to website and its services.
Certnomics.com.au shall not be deemed accountable for the loss of validity of Learner/Participant Account as the result of any malicious activities at the end of 3rd Party, which are otherwise outside the scope and control of the website.
Certnomics.com.au is offering eLearning services to Participant/Learner/Website User through the way of granting access to the wide range of practice tests, general courseware and information and data available in Audio/Video Format, or Graphics, or Recorded Scripts and also any type of format that is read by machine. The certifications and courseware included within are provided to the Learners/Participants/Website Users in the online format ONLY. Certnomics.com.au can make amendments or revisions and updates to the course curriculum anytime, which is considered apt and relevant for the students.
Certnomics.com.au provide Participants/Learners/Website Users with a completely personalized, non-transferable and non-exclusive license, which is revocable. The license will remain valid until the Participants/Learners/Website Users utilize the Website and Services and benefit from the Content and the Courseware until a Certificate is issued.
We shall offer services as well as content and the courseware with the purpose of offering personal and non-commercial intention. The services are also important in assisting the completion of the certification training registered for (“Restricted Purpose”).

Neither certnomics.com.au, nor any of its partners are either directly or indirectly involved in Services, Content and the Courseware. Therefore, as the result, we and neither of our partners shall be held directly or indirectly consequential, incidental or reasonably connected to consequential damages of any kind. We are not liable for risks arising from damages due to Website Use, or the Use of Services and Content and the Courseware.
The Participants/Learners/Website Users accept that neither Certnomics.com.au and nor any of its affiliates, directors, officers, employees, agents and licensors shall become accountable or answerable in any manner for defamation suits, or unscrupulous demeanor of 3rd Parties, or malicious intentions, or the Website Services, or Presentations of Content and the Courseware. In all such cases, the occurrence of damages, or risk of faltering shall remain with the respective Participant/Learner/Website User.
The Participants/Learners/Website Users may disclaim their liability due to the occurrence of damages or possibilities of injuries to Intellectual Property Rights by means of wrongful intentions or errors arising from the omissions or deletions, or interruptions or viruses/malware in the computers or occurrence of failure in the communication.
Similarly, the Participants/Learners/Website Users may have sufficient reasons to disclaim their liability due to the personal identity theft, or breach of the contract, or negligence that may otherwise affect deliverance of courseware.
The Participants/Learners/Website Users completely agree that legal responsibility of Certnomics.com.au or the accountability of its affiliates, directors, officers, employees, agents and licensors shall not be the direct response to the Website, Services Offered, the Content and the Courseware.
Should any legal prerogative come forth as in Agreement/Contract/Tort or likewise that may address the sensitivities regarding the Services offered on the Website, or Seriousness of the Content, or Courseware thereof, then such a claim or prerogative will not overcome the fee paid to Certnomics.com.au against specific certification.
Terms of Use, or The Agreement (as known herewith within the Conclusive Nature of Dossier) becomes functionally operative ONLY if Participants/Learners/Website Users accept the Agreement in Toto. When the Participants/Learners/Website Users click on “I ACCEPT” Button, they are subjected to Terms and Conditions delineated within the agreement. The Terms and Conditions and their adherence to the Agreement shall remain in effect ONLY until the Participants/Learners/Website Users maintain FULLY PAID-UP ONLINE PARTICIPANT ACCOUNT, or may otherwise be terminated by the management of Certnomics.com.au, depending on the management and its priority.
Certnomics.com.au has legal right to terminate the Agreement and discontinue the access immediately to the account of Participants/Learners/Website Users as result of which they cannot get the Services, Content, and the Courseware.
The termination is activated by way of emailing the notification to Participants/Learners/Website Users with “Immediate Termination Date” should such a termination is catapulted as the result of either delinquency, or misrepresentation or breach of the responsibilities as you had consented within the Agreement (in the case where Participants/Learners/Website Users show up as defaulter).

The Participants/Learners/Website Users will assent to the fact of indemnifying Certnomics.com.au and all its affiliates, directors, officers, employees, agents and licensors will not be held responsible for any possible claims, or potential losses, or liabilities, or any known or unknown damages, which also includes the legal expenses such as the Fee of the Attorney.
The Participants/Learners/Website Users shall also agree that they will not hold Certnomics.com.au and any of its affiliates, directors, officers, employees, agents and licensors responsible, if the Participants/Learners/Website Users may use unscrupulous tools or methodologies to extract the information from the website. May we remind that all such actions will be clear violation of safety and security and Breach of the Agreement and all the provisions.
In the event where certnomics.com.au shall not be in a condition to enforce the legal obligations or any of the provisions outlined within Terms of Use, or any Terms related to Courseware, then the Participants/Learners/Website Users shall not put forth intentionally the waiver of any right or provision or the Terms of Use henceforth.
Should any of provisions delineated in Terms of Use or Program-specific Terms shared with Participants/Learners/Website Users by the management of certnomics.com.au are deemed to be found non-legit by the court and/or do not confirm to the law of the land, then all parties that are the part of such terms shall adhere to the order of the court. Such an order dictates the intent and will be the guide for carrying ahead the Terms of Agreement as well as Program Specific Terms within the purview of law. The clauses and provisions of Terms of Use shall remain effective and viable.
Certnomics.com.au enjoys the freedom to either assign and/or delegate certain parts of Terms of Use or enforce complete agreement thereof. Furthermore, certnomics.com.au also have the freedom to transfer or delegate or assign Terms of Use or Program Specific Terms within legal procedures.
Participants/Learners/Website Users have no right of transferring the rights or delegate their obligations to any 3rd Party without an explicitly written consent and undersigned by Certnomics. If the Participants/Learners/Website Users make deliberate attempt of transferring the rights or delegate the Terms of use of Courseware or Content, then such transference shall be deemed ineffective.
Note – There is absolutely no waiver of any Right, or Terms of Use, unless such waiver is defined and authorized by Certnomics and falls in the legal dominion and discussed in court of law.
There is quite a likelihood where certain provisions of the agreement become invalid, or cannot be enforced according to the laws of the land. In such occurrences, the remaining provisions of Terms of Use and Course Program specific Terms shall remain in place and in effect during entire session.
The clauses or provisions of Terms of Use that are otherwise deemed to be unenforceable, shall be replaces with enforceable provisions. Such replacements shall become valid and active in the interest of all active parties that are signatories to the agreement and all the clauses thereof.
The Participants/Learners/Website Users residing in the USA or have nationality of the USA shall be administered within the protocols of Laws of Massachusetts and heard and presided over in the Massachusetts Courts will preside over their special jurisdiction over any matters considered important and of high priority, or otherwise and have direct or indirect relationship within the scope of the Agreement.
The Participants/Learners/Website Users who do not reside in the USA or do not have nationality of the USA shall enjoy exclusive jurisdiction with respective laws of land where they reside. Such participants/Learners/Website Users have the rights safeguarded within the respective jurisdictions of the land where they reside.
Certnomics.com.au enjoys obligatory right to alter the Terms of Use of the Agreement without any consent of 3rd Party, or consent of The Participants/Learners/Website Users. In the similar way, if Participants/Learners/Website Users browse the website, or access the Services, the Content and the Courseware after the changes are made, the same shall be deemed as an acceptance to such changes.
It is whole and sole accountability of the Participants/Learners/Website Users to keep updated on the provisions of Terms of Use and the Courseware. The Participants/Learners/Website Users should also keep track of revisions, or modifications and all types of amendments.
The Participants/Learners/Website Users shall not have any explicit permission for assigning the Agreement or the Obligatory Rights defined therein to 3rd Parties. In case of the Participants/Learners/Website Users manipulate any of the provisions of the Agreement, S/he shall be held liable for the breach and tried in the court of law.
The term Agreement is defined in respect of Nature of its Comprehensiveness and shall include the Privacy Policy, Refund Policy, Disclaimer, and the Terms of Use respectively. The comprehensive agreement shall prevail in all set of conditions wherein the Participants/Learners/Website Users shall follow and concord with clauses in toto and ensure the use of Courseware and its Content purely for the learning purpose. The same also holds true in context of the Certifications received thereof.
